Overview of District: Moody River Estates CDD is a beautiful community encompassing an area of approximately 320 acres located in North Fort Myers, Lee County, Florida. The District is surrounded by residential subdivisions as well as the Caloosahatchee River to the South, Hancock Bridge near the North and West sides, and Moody Road and a section of undeveloped property to the East.
The District contains 755 residential units comprised of single family and multifamily residential units, 69 un-platted lots, 21 stormwater system lakes to retain the water table and to detain and filter the water from rain events for both residents and the city-wide stormwater system at large, and so benefiting both residents of the District and the general public of Lee County, Florida. Moody River Estates CDD is responsible for the operations and maintenance of the District’s infrastructure including the stormwater management system, lake maintenance, preserve and wetlands maintenance, a portion of the community signage, and administrative/community costs and reserves.
The CDD is governed by a 5-member elected or appointed Board of Supervisors. The Board is responsible for actions to manage the CDD it represents.
In addition, the Board enlists a group of professionals to support the needs of the District:
- Field Manager: Chris Pepin assists the District with on-site maintenance projects, asset inspections, and other field services.
- District Management: Premier District Management handles the financial, administrative and day-to-day needs of the District.
- District Counsel: Attorney Mike Eckert handles the legal needs of the District.
- District Engineer: Engineer Carl Barraco serves as the consulting engineer for the District.

Moody River Estates CDD has established the following goals, objectives and performance measures/standards for the Fiscal Year 2025:
1. Community Communication and Engagement

Goal 1.1: Public Meetings Compliance
- Objective: Hold at least 4 regular Board of Supervisor meetings per year to conduct CDD related business and discuss community needs. Regular meetings are open to the public and agendas will include time for the public to make comments.
- Measurement: Number of public board meetings held annually as evidenced by meeting minutes and legal advertisements.
- Standard: A minimum of 4 board meetings were held during the Fiscal Year.

Goal 1.2: Notice of Meetings Compliance
- Objective: Provide public notice of each meeting at least seven days in advance, and notice of annual meeting schedule. Notice to be shared on CDD website and published in a local newspaper.
- Measurement: Timeliness and method of meeting notices as evidenced by posting to CDD website, publishing in local newspaper.
- Standard: 100% of meetings were advertised with 7 days notice per statute or by annual notice of meeting schedule via newspaper, and on CDD website.

Goal 1.3: Website Public Records
- Objective: Ensure that meeting minutes, agendas, and other statutorily required district records are readily available and easily accessible to the public by completing quarterly CDD website checks.
- Measurement: Quarterly website reviews will be completed to ensure meeting minutes and other public records are up to date as evidenced by District Management’s records. Website reviews will also include running an ADA compliance report on all pages of the website.
- Standard: 100% of quarterly website checks were completed by District Management.

2. Infrastructure and Facilities Maintenance

Goal 2.1: District Infrastructure and Facilities Inspections
- Objective: Field Manager will conduct at least 6 inspections per year of the District’s infrastructure and related systems.
- Measurement: A minimum of 6 inspections completed per year as evidenced by Field Manager’s report related to District’s infrastructure and related systems.
- Standard: Minimum of 6 inspections were completed in the Fiscal Year by the District’s Field Manager.

Goal 2.2: District Lakes Maintenance
- Objective: District’s Lake Maintenance Vendor will conduct regular inspections and treatments of the lakes.
- Measurement: A minimum of 4 inspections/treatments completed per year as evidenced by Lake Maintenance Vendor’s service reports.
- Standard: Minimum of 4 maintenance/treatment events were completed in the Fiscal Year by the District’s Lake Maintenance Vendor.

Goal 2.3: District Preserve Maintenance
- Objective: District’s Preserve Maintenance Vendor will complete annual inspections of the preserves.
- Measurement: A minimum of one inspection completed per year as evidenced by Preserve Maintenance Vendor’s report.
- Standard: Minimum of one inspection was completed in the Fiscal Year by the District’s Preserve Maintenance Vendor.

Goal 2.4: District Storm Water System Maintenance
- Objective: Field Manager will conduct at least 6 visual inspections per year of the District’s stormwater system. Field Manager to recommend further inspection, cleaning or repairs as needed.
- Measurement: A minimum of 6 visual inspections completed per year as evidenced by Field Manager’s report related to District’s stormwater system.
- Standard: Minimum of 6 visual inspections were completed in the Fiscal Year by the District’s Field Manager. Stormwater structures were last inspected in FY ___ and cleaned in FY ___.

Goal 2.5: 20-year Stormwater Needs Analysis Reporting
- Objective: District to develop and submit to the County a 20-Year Stormwater Needs Analysis with updates every 5 years per Florida Statutes. The first cycle of reports was due by June 30, 2022. The next reporting cycle will begin in 2027.

Goal 2.6: Lake Bank Restoration
- Objective: Moody River Estates CDD’s lake restoration plan consists of five objectives over the course of 8 years (FY 2023 – FY 2031): 1) Planting a sufficient littoral shelf on all lakes. 2) Ensure sufficient aeration is in each lake. 3) Address erosion issues as identified by the Field Manager and District Engineer. 4) Installation of additional deep lake shade trees as required by permits. 5) Remove exotic vegetation as identified by the CDD Field Manager.
- Measurement: Repair shoreline erosion in a minimum of one lake per fiscal year, plant a sufficient littoral shelf and any required deep lake shade trees on a minimum of one lake per fiscal year, ensure sufficient aeration in all lakes, and ensure exotic vegetation around lakes is removed.
- Standard: Address erosion and plant a littoral shelf/deep lake shade trees on a minimum of one lake per fiscal year and have lake bank certified by the County. Sufficient aeration and exotic vegetation removed in/on all lakes per CDD Field Manager’s report.

3. Financial Transparency and Accountability

Goal 3.1: Annual Budget Preparation
- Objective: Prepare and approve the annual proposed budget by June 15 and adopt final budget by September 30 each year.
- Measurement: Proposed budget was approved by the Board before June 15 and final budget was adopted by September 30 as evidenced by meeting minutes. Budget documents listed on CDD website, within District records and sent to the County at least 60 days prior to the public hearings.
- Standard: 100% of budget approval & adoption were completed by the statutory deadlines, posted to the CDD website and sent to the County at least 60 days prior to the public hearings.

Goal 3.2: Annual Financial Audit
- Objective: Conduct an annual independent financial audit per statutory requirements and publish the results to the CDD website for public inspection, and transmit to the State of Florida.

Goal 3.3: Assessments Notification
- Objective: Notification of annual assessments posted to the District’s website after adoption of annual budget.

- Standard: Assessment values to be accessible on CDD website within 30 days of adoption of annual budget.

4. Board of Supervisors Annual Requirements

Goal 4.1: 4 Hours of Annual Ethics Training for Supervisors
- Objective: Board of Supervisors to take 4 hours of ethics training classes annually.
- Measurement: Self-report of course work, certificate (if applicable) and dates of courses recorded by each Supervisor.
- Standard: All five Supervisors to complete two (2) hours of Ethics Law, one (1) hour of Sunshine Law and one (1) hour of Public Records Law training classes. Training is reportable on the e-filing of the annual Form 1 in the following fiscal year.

Goal 4.2: Form 1 and Form 1F Statement of Financial Interests
- Objective: Each Supervisor to complete the annual Form 1 and/or Form 1F when leaving office (if applicable), within statutorily required time.
